Former Nebraska and Arizona State quarterback Sam Keller is tackling EA into court over misuse of his likeness. He will be backed up by the NCAA which will be suing them over the likenesses of several players.
Estimates of upcoming EA losses are spotty at best, with numbers ranging from millions to one billion dollars. It all comes down to how many athletes will be in the class action, and how hard the judge wants to punish EA.
EA is arguing First Amendment protection for a major commercial venture, which is a shaky if not useless defense. So far EA employees are not worried and are even making jokes: “We could lose billions more if a giant meteor hits the earth.” said EA spokesman Jeff Brown in a USA Today interview.
